1.Who we are
OutrightSite is a trading name of Rene Roach, a sole trader based in England and Wales ("we", "us", "our").
- Address for service: 61 Bridge Street, Kington, HR5 3DJ, United Kingdom
- Contact: [email protected]
By buying a build from us, you ("you", "the customer") agree to these terms.
2.What we do
We build a small business website and hand it over to you, once, for a one-time fee.
- We design the site, write the copy from the details you give us, add licensed photographs, and deploy it.
- We deploy everything into your own accounts: your domain, your code repository (GitHub), and your hosting (Cloudflare).
- When the build is finished we hand it over. From that point the site is entirely yours.
We are a one-time build service. We are not a hosting provider, an ongoing maintenance service, or a marketing agency.
2a.Who this service is for
OutrightSite is a service for businesses. We build websites for people acting in the course of their trade, business, craft or profession — sole traders, partnerships and companies buying a site for their work.
By buying a build, you confirm that you are entering into this contract for the purposes of your trade, business, craft or profession, and not as a consumer. These terms are written on that basis and take effect as a business-to-business contract, including the way liability is limited in section 10.
If you are a consumer. If, despite the above, you are in law a consumer (an individual acting wholly or mainly outside your trade, business, craft or profession), nothing in these terms removes or limits the statutory rights you have that cannot be excluded — including your right to a service carried out with reasonable care and skill, and your cancellation rights in section 9. Where any term here would conflict with those rights, your statutory rights come first.
3.What you need to provide
- Your own GitHub account (for the code).
- Your own Cloudflare account (for hosting and analytics).
- A domain name that is on your Cloudflare account, or a new one you register.
- Accurate business details, and the right to use any content you give us.
You are responsible for keeping your account logins safe. We do not keep copies of them after handover.
3a.Existing domains and email
You can bring a domain you already own, or register a new one.
- If you bring a domain you already own, we point it at your new site, and any website currently published at that domain is replaced by the site we build. You are responsible for keeping that domain registered and paid for.
- We build websites. We do not set up, host, migrate, or manage email. If you use email on your own domain (for example name@yourdomain), that email is provided by a third party and remains entirely your responsibility. We do not move it and we are not responsible for its continued operation.
- Moving a domain, or ending payment for a domain or its associated services, can cause any email attached to that domain to stop working. That is outside our control. If keeping email that runs on your existing domain matters to you, keep that domain and its email service in place, and take your own advice before making changes.
- For this reason we build only on domains that are clean or new, and we do not migrate email as part of a build.
4.The fee
The build fee is a one-time charge, shown to you at checkout before you pay (currently a £299 founding price, with a standard price of £399). Payment is taken securely through Stripe. There are no monthly fees payable to us.
The fee does not include third-party costs that you pay directly to others, such as your domain renewal (typically £1 to £20 a year, paid to your registrar). Cloudflare hosting and analytics are on their free tier at the time of writing.
5.Ownership and intellectual property
We want you to genuinely own your site, and we word this carefully so that it is true:
- The custom work we create for you — your site's design as assembled for your business, the written copy, and the configuration — is assigned to you in full once you have paid. Those custom parts are then yours.
- The domain, the code repository (GitHub) and the hosting (Cloudflare) sit in accounts that belong to you, in your own name. We keep no ownership, no ongoing control, and no copies of your credentials.
- Open-source and third-party components used to build your site — for example Astro and Tailwind CSS (MIT licensed), the web fonts (open font licences), and stock photographs (licensed through Pexels, where the photographer keeps the copyright) — remain owned by their respective owners and are provided to you under their own standard licences, not owned by you. You may use them as part of your site under those licences; you may not, for example, resell the stock photographs on their own.
- We assign the rights we hold in the custom work. We do not warrant that the open-source or third-party components are free of any third-party claim beyond the protection their own licences provide.
- If OutrightSite stopped operating tomorrow, your site would keep running. Any developer can take it on.
6.Third-party services
Your finished site relies on services provided by third parties, under their own terms: Cloudflare (hosting and analytics), your domain registrar (the domain and its yearly renewal), GitHub (your code), and Web3Forms (delivering your contact-form enquiries to you).
We are not responsible for these third parties' pricing, outages, changes, or account decisions. Your relationship for those services is with them, not with us.
7.Your content and your responsibilities
- You confirm the business details you give us are accurate, and that you have the right to use any material you provide.
- You are responsible for the lawfulness of your content and for how you run your business.
- Photographs on your site are stock images licensed through Pexels for use on the site. Please review them and swap in your own where you prefer.
- Testimonials and reviews are left for you to add as real ones come in. We never invent them.
8.What we do not promise
We build your site to a good standard, but we do not guarantee business outcomes.
- We do not guarantee search rankings, traffic, sales, or any commercial result.
- The quality scores shown in your handover pack reflect the site at the moment of handover only.
- After handover, changes you or others make to the site, the domain, or the underlying accounts are outside our control.
9.Cancellation and refunds
Each site is built to order for your specific business.
- Before we begin work, you may cancel for a full refund.
- If you are a consumer buying online, you would normally have a 14-day cooling-off period. Because your site is built to order and delivered quickly, at checkout you expressly ask us to begin during that period and acknowledge that once your finished site has been delivered you lose the right to cancel, because the service has then been fully performed at your request.
- Once we have begun the bespoke work but before delivery, we may retain a fair amount for the work already carried out.
- Once your finished site has been delivered, the fee is non-refundable to the fullest extent the law allows, because the work has been performed in full for you.
10.Liability
We provide the service with reasonable care and skill. Because this is a business-to-business contract (see section 2a), the limits below are intended to be reasonable for a one-time, fixed-fee service. To the fullest extent allowed by law:
- Our total liability to you for anything connected with the service is limited to the amount of the build fee you paid.
- We are not liable for indirect or consequential loss, lost profits, or lost business.
- We are not liable for problems caused by your own accounts, by third-party services, or by changes made after handover.
Nothing in these terms limits liability that cannot be limited by law, such as liability for death or personal injury caused by negligence, or for fraud.
11.Data protection
We only use the business details you give us in order to build and hand over your site. We do not sell them. We do not keep your account credentials after handover. We handle personal data in line with UK GDPR. Our full privacy policy is at outrightsite.com/privacy.
12.Changes to these terms
We may update these terms from time to time. The version that applies to your build is the one published when you paid.
13.Governing law
These terms are governed by the law of England and Wales, and any disputes are subject to the courts of England and Wales.
